Medical marijuana may be legal in New Mexico, but if state workers give patients the drug, they could face prosecution. The new law that passed this year allows people with certain medical conditions to apply for a license to use the drug. But New Mexico Attorney General Gary King said that anyone who has a hand in the process could be subject to federal law.
In 2001, the Supreme Court ruled that all marijuana manufacturing and distribution, even for medical purposes, is illegal. The attorney general said there is no guarantee federal prosecutors would come after New Mexico employees, but there is no guarantee they wouldn't either.
